By accessing the Site, submitting a form, or interacting with our AI agents, you agree to these Terms. If you do not agree, do not use the Site or services.

1. Eligibility
You must be at least 18 years old and have the legal authority to enter into a binding agreement to use our services. By using the Site, you represent and warrant that you meet these requirements.

Stakd Systems provides:
- AI-powered receptionist and customer engagement services for small businesses
- An AI Demo on Demand system that allows prospects to interact with our AI agents via SMS or inbound voice call
- Implementation, training, and ongoing support of AI agents on the HighLevel platform
- Sales and marketing automation services for contractors and service businesses
Specific deliverables, pricing, and terms for paid engagements are governed by separate written agreements.
3. AI Demo on Demand
The Demo on Demand is provided free of charge for evaluation purposes only. By submitting the demo form, you:
- Authorize us to contact you via the methods you select (SMS, inbound call, outbound call)
- Acknowledge the responses you receive are generated by an AI agent
- Understand the demo is not legal, financial, medical, or other professional advice
- Consent to one or more follow-up messages from Stakd Systems related to the demo
Demo content, scripts, and AI behavior are subject to change without notice.
4. SMS Messaging Terms
Use of our SMS services is subject to your separate, explicit opt-in via the consent checkbox on the demo form. Full SMS terms — including frequency, opt-out, help, and carrier disclaimers — are described in our Privacy Policy.
By opting in, you agree:
- You are the account holder of the phone number provided, or you have authorization from the account holder to opt in
- Message frequency varies; message and data rates may apply
- You may reply STOP at any time to opt out, and HELP for assistance
- We are not liable for delayed or undelivered messages caused by carriers or device issues
We may suspend SMS service to any phone number that we reasonably believe is being used in violation of these Terms, applicable law, or carrier policies.
5. Acceptable Use
You agree not to use the Site or our services to:
- Violate any law or regulation
- Impersonate any person or entity
- Harvest information from other users
- Interfere with or disrupt our services or servers
- Attempt to gain unauthorized access to any system
- Send spam, harassing, or unlawful messages through any channel we provide
- Reverse engineer or scrape our AI agents
We reserve the right to terminate access for any violation.
6. Intellectual Property
All content on the Site — including text, graphics, logos, AI agent prompts, software, and the Stakd Systems name and brand — is owned by Stakd Systems or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any of our content without our prior written consent.
7. Third-Party Services
The Site and demo may include integrations with or links to third-party services (e.g., HighLevel, Twilio, Google, Stripe). We do not control and are not responsible for the content, policies, or practices of those third parties. Your use of those services is governed by their own terms.
8. Disclaimers
The Site and AI Demo on Demand are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Site or services will be uninterrupted, secure, or error-free
- AI agent responses will be accurate, complete, or appropriate for your use case
- Defects will be corrected
9. Limitation of Liability
To the fullest extent permitted by law, Stakd Systems and Stakd Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of the Site or services, even if advised of the possibility of such damages.
Our total liability for any claim arising from these Terms or your use of the Site shall not exceed one hundred U.S. dollars ($100) or the amount you paid us in the twelve months preceding the claim, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Stakd Systems, Stakd Systems LLC, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Site or services
- Your violation of these Terms
- Your violation of any law or third-party right
11. Termination
We may suspend or terminate your access to the Site or services at any time, with or without cause and with or without notice. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification) shall survive.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Weber County, Utah, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
